TERMS AND CONDITIONS FOR TELE CONSULTATION

This website and the tele consultation services provided on this website are hosted by UNIMED HEALTH CARE PRIVATE LIMITED. Any individual availing UNIMED HEALTH CARE PRIVATE LIMITED tele consultancy services will be referred to as Patient or You.

The Patient’s use of this website and the tele consultancy services is subject to the Patient’s acceptance of these Terms and Conditions for Tele Consultation. By clicking “accept”, you agree that you have read and understood all the terms and conditions, and agree to be bound by them unconditionally.

The following are the terms of use of the tele consultation services of Unimed health care private limited:

1. Services Provided:

a. For the convenience of Patients during times of limited physical mobility, UNIMED HEALTH CARE PRIVATE LIMITED is providing tele consultation services to the Patients, which means that Patients can consult the doctors of UNIMED HEALTH CARE PRIVATE LIMITED through our website, using audio-visual media. This is a support service for the benefit of the Patients due to the situation arising out of the current situation of Covid-19.

b. The tele consultation allows only for a dialogue between you and the doctor about your clinical symptoms and your available reports, so that a best possible advice can be given within the limitations of the service since there is no possibility of a physical examination.

c. The timings for the tele consultation are from 9 am to 5 pm.

d. A session of the tele consultation will be for a period of 15 minutes. These terms and conditions are applicable for one tele consultation only. There will be no follow up or free tele consultation and any additional session has to be booked by the patient and the payment would need to be made for the same separately.

e. Each Patient will be required to log-in to our website to avail the tele consultation services. Log-in is only permitted through verified documents such as AADHAR Card or Driving License of the Patient.

f. This service has the provision for you to choose a specialty. The specialist on duty shall attend to your tele consultation. The tentative consultation time will be shared in advance but this could change if the specialist is attending to an emergency or is unavailable for unavoidable reasons. The Schedule for the tele consultation will be on a first-come basis.

g. The fees for the tele consultation are Rs. _________ per session of consultation. The Patient should pay the fees through our website prior to the tele consultation, and tele consultation will be available to the Patient only upon full payment of the fees.

a. For the convenience of Patients during times of limited physical mobility, UNIMED HEALTH CARE PRIVATE LIMITED is providing tele consultation services to the Patients, which means that Patients can consult the doctors of UNIMED HEALTH CARE PRIVATE LIMITED through our website, using audio-visual media. This is a support service for the benefit of the Patients due to the situation arising out of the current situation of Covid-19.

h. The Patient expressly understands that tele consultation is only for routine or nonthreatening medical advice, and NOT FOR EMERGENCY SITUATIONS.

i. After the tele consultation, the respective doctor may prescribe certain medicines for the Patient. It is the Patient’s responsibility to procure the medicine and take it in the prescribed manner. UNIMED HEALTH CARE PRIVATE LIMITED will not be responsible for the same.

j. UNIMED HEALTH CARE PRIVATE LIMITED has the right to stop the tele consultation services at any point of time. If a Patient has paid for a tele consultation session and is unable to take the session due to stoppage of the facility by UNIMED HEALTH CARE PRIVATE LIMITED, UNIMED HEALTH CARE PRIVATE LIMITED will refund the amount within 7 days.

k. Any prescription/medical consultation/medical advice given by our doctors during tele consultation will be based on the limited information available with the doctors, which is supplied by the Patient during the tele consultation session. UNIMED HEALTH CARE PRIVATE LIMITED or its doctors will not in any manner be responsible or liable for consequences arising from any act or omission of the Patient pursuant to the tele consultation.

l. Prescriptions for scheduled medications, non-therapeutic drugs and certain other drugs which may be harmful because of their potential for abuse will not be prescribed through etele consultation.

m. The service shall take all efforts to ensure the confidentiality and privacy to all the stored clinical and personal information that you have provided while using this service as per the statutes and limitations of the current scenario.

2. Patient’s Undertaking:

The Patient undertakes that:

a. The Patient is at least 18 years old.

b. The Patient understands all the terms and conditions set out herein.

c. The Patient has submitted authentic verification documents.

d. The Patient will give the doctors correct and authentic information during the tele consultation, including personal data, medical history, medical reports, previous consultations/prescriptions, and any other information which may be asked for by the doctor. The Patient will not give any inaccurate information/mis-information/ false information.

e. The Patient consents to audio and video recording of the tele consultation sessions, along with making a record of all the data, information, and documents submitted by the Patient (including lab and radiology report). Such recording will be kept confidential by UNIMED HEALTH CARE PRIVATE LIMITED and will only be used internally by UNIMED HEALTH CARE PRIVATE LIMITED to enable them to provide better services. It will not be shared with any third party unless required by law.

f. The tele consultation is only for the personal use of the Patient.

g. For any prescription issued during tele consultation, the Patient agrees to fully and carefully read all provided product information and labels and to contact a physician or pharmacist if he/she has any questions regarding the prescription.

3. Limitation of Liability:

a. Any medical advice, diagnosis, prescription, etc. given by a doctor of UNIMED HEALTH CARE PRIVATE LIMITED during tele consultation will be based on the limited information available to the doctor, and subject to the authenticity of the information and to availability of optimum-level technological support on both sides. Therefore, neither UNIMED HEALTH CARE PRIVATE LIMITED nor any of its doctors or representatives will be liable for misdiagnosis / faulty judgment / interpretation error / perception error/adverse events/ inefficacy of prescribed treatment or advice/validity of the advice or prescription provided by the consulting doctor in your jurisdiction of residence/ unavailability of the recommended or prescribed treatment or medication under any condition or circumstances.

b. UNIMED HEALTH CARE PRIVATE LIMITED, its affiliates, doctors, representatives or employees shall not be liable for any deficiency in the tele consultation services caused due to the occurrence of sub optimal technical conditions (such as, poor network connectivity, power shutdown, service downtime, scheduled maintenance work by the internet service providers, technical failure, software malfunction, etc.)

c. Although UNIMED HEALTH CARE PRIVATE LIMITED will make its best efforts to ensure the use of data protection and software security protocols, if the same fail due to any reason, UNIMED HEALTH CARE PRIVATE LIMITED, its affiliates, doctors, representatives or employees shall not be liable for such failure, and any breach of privacy, data protection, or other breach resulting from such failure.

d. In any event, the liability of UNIMED HEALTH CARE PRIVATE LIMITED, its affiliates, doctors, representatives or employees will be limited to the consultation fees paid by the Patient. UNIMED HEALTH CARE PRIVATE LIMITED will not be responsible for any loss or damage, whether direct or indirect, caused due to the Patient’s breach of any of the terms and conditions set out herein, or for any indirect loss or damage caused due to either’s party’s breach of any of the terms and conditions set out herein.

e. Notwithstanding anything herein to the contrary, UNIMED HEALTH CARE PRIVATE LIMITED shall not be liable for any losses arising out of the delay or interruption of its performances of any obligations due to Force Majeure (i.e. any act of God, act of governmental authority, act of public enemy, war, severe weather conditions, epidemic, natural disaster, or any other cause beyond its control).

4. Indemnity

The Patient agrees and undertakes to indemnify and keep indemnified UNIMED HEALTH CARE PRIVATE LIMITED, its affiliates, doctors, representatives and employees (“Indemnified Parties”) for any losses, costs, charges and expenses including reasonable attorney fees that the concerned doctor/physician and Indemnified Parties may suffer on account of the Patient’s:

a. Failure to provide correct and authentic information including personal data, medical history, medical reports, previous consultations/prescriptions, and any other information which may be asked for by the doctor.

b. Suppression of material facts, or providing incomplete, inaccurate, or false information.

c. Failure to follow doctor’s advice / prescription accurately.

d. Failure to protect the security of the Patient’s log-in account for the UNIMED HEALTH CARE PRIVATE LIMITED website.

5. Miscellaneous

a. This agreement constitutes a binding contract between the Patient and UNIMED HEALTH CARE PRIVATE LIMITED. It will stand automatically terminated after completion of the tele consultation. However, the clauses on Limitation of Liability and Indemnity will continue to operate.

b. UNIMED HEALTH CARE PRIVATE LIMITED may at any time, without any prior notification, modify these terms of conditions. The Patient is requested to review the latest version of the terms and conditions before proceeding to avail the tele consultation service.

c. No delay on the part of any patty in exercising any right, power or privilege hereunder shall operate as a waiver thereof.

d. If any term of this agreement is held to be illegal, invalid or unenforceable, the legality, validity and enforceability of the remaining terms shall not be affected or impaired.

e. This agreement shall be governed by the laws of India and shall be subject to the exclusive jurisdiction of the courts at Hyderabad. Any dispute, failing amicable resolution, shall be referred to and finally resolved by arbitration to be conducted in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English by a sole arbitrator who shall be mutually appointed by the parties. The seat of arbitration shall be Hyderabad, India. Any award made by the arbitrator shall be binding on the parties.

CONSENT OF THE PATIENT:
I have read the terms and conditions for Tele Consultation and I agree to the terms and conditions.
